Sehr geehrte Damen und Herren des deutschen Bundestages und Mitglieder des Petitionsausschusses.

In der Sitzung des Petitionsausschusses vom 05.11.2012, Tierschutz, lehnten Sie eine Änderung des Tierschutzgesetzes § 3 im Sinne unserer Petition, die ein ausdrückliches Verbot von Verkauf, Erwerb und Anwendung von Stachelhalsungen aller Art forderte, aus verschiedenen Gründen ab.

Einige der genannten Gründe sind akzeptabel und auch nachvollziehbar.

Ihr Hauptargument, dass mit dem vorhandenen Gesetzestext  §3 Nr.5… es ist verboten, ein Tier auszubilden oder zu trainieren, sofern damit erhebliche Schmerzen und Leiden für das Tier verbunden sind…, alle Zwangsmittel, u.a. Stachelhalsungen gesetzlich abgedeckt sind, findet nicht unsere Zustimmung.

Unser Vorschlag, trotz ihrer kurzfristigen Aussetzung der Novellierung des Tierschutzgesetzes, wäre, eine klarere Formulierung des bestehenden Textes, um mögliche Fehlinterpretationen zu vermeiden. Der Umstand, dass es sich um „erhebliche“ Schmerzen handeln muss, ist für uns untragbar. Hier kann sich jeder, der strafrechtlich verfolgt werden sollte, auf seine persönliche  Definition des Schmerzmaßes „erheblich“ zurückziehen, mit fatalen Folgen für die Tiere.

Wir fordern Sie daher auf, das Wort „erheblich“, ersatzlos aus dem Gesetzestext zu streichen, um dieser rechtlichen Grauzone im novellierten Tierschutzgesetz keinen Raum mehr zu billigen.

Justice for Abused Dog That Endured Surgery to Remove Choke Collar - A dog was reportedly found suffering from a severe neck infection due to a choke collar that had embedded so far into its neck that it had to be surgically removed. People from the Society for the Prevention of Cruelty to Animals (SPCA) said that the

infection was so bad that the owners couldn’t have missed it.  If convicted, the owners of this dog only face a fine and a small two-year sentence, which is a slap on the wrist for someone who’s allowed their animal to suffer to this extent :-/

The poor dog was 40 pounds underweight and suffered gunshot wounds to two legs, cuts all over its body, and a gash around its neck that is believed to have been caused by an electric shock collar.
